Terms and Conditions

The following Terms and Conditions are part of the rental contract (the “Contract”) governing the usage of Can Lupal, located at c/ Torrente Can Creueta, 10 in 07100 Sóller, Spain (the “Property”). By making a booking for the usage of the Property, the renters of the Property (the “Renters”) agree to be bound by these Terms and Conditions as well as the terms of the Contract concluded between the Renters and Lupal Sóller SLU (the “Owner”).

The Renters confirm and agree that:

they are each at least 24 years of age and will be the Renters bound by the Contact including these Terms and Conditions. 

The Renters agree that they are entirely responsible for the actions of any accompanying guests (including any visitors or other persons to whom the Renters grant access to the Property).

the maximum occupancy for the Property is 10 persons (adults and children). The Renters agree to ensure that overnight stays will be limited to 10 persons.

any reservation obtained under false pretences will lead to immediate forfeiture of deposits and/or rental fees and that the Renters will not be permitted to check in. Renters who have already checked in and who are subsequently found to have used the Property under false pretences will forfeit the return of the security deposit (see below).

Personnel including cleaners, gardeners, and maintenance personnel may enter the Property during normal working hours.

any accident or personal injury as well as loss of or damage to any personal items or other property is fully covered under their own insurance. Any accident, injury or loss of or damage to any personal items will need to be claimed from the Renters’ insurances as Lupal Sóller SLU excludes any and all liability or responsibility for injury, damage, loss or theft.

No early arrival (before 4:00 pm on the arrival date) or late departure (after 10:00 am on the departure date) will be possible unless agreed otherwise in advance  in writing by the Property Manager Tisha (Patricia) Dawson, the “Manager”.

The Pool is heated to a minimum temperature of 25°C from 1 April to 31 October. Outside these dates, we will attempt to meet your requirements, but pool usage is subject to feasibility, prior and possibly surcharges

Notwithstanding the foregoing and in any case, use of the swimming pool is prohibited when the pool cover is fully or partially closed. USE OF THE SWIMMING POOL WHEN THE COVER IS NOT COMPLETETLY OPEN IS EXTREMELY DANGEROUS AND THEREFORE SCRICTLY PROHIBITED. DROWNING, LOSS OF LIFE OR SEROIUS INJURY CAN RESULT FROM ENTERING THE POOL WHENEVER THE COVER IS NOT 100% OPEN.

The Renters agree that they will (in all cases within the allotted timeframe and in any case without undue delay): 

make all payments promptly and on time as agreed under the terms and conditions agreed with HomeAway and via HomeAway Payments.

return to the Manager the traveller registration forms as required by Spanish law for each and every guest, 16 years or older with all the required information and signed within 12 Hours of their arrival.

assess any safety hazards that may exist (particularly for any children) on the Property including the gardens, swimming pool and water tank and to take steps to protect against such hazards. The pool is not fenced and children must be supervised at all times. The Owner makes no representation that the Property is suited for children and excludes any and all liability for any injury, death or damage to property resulting from the existence of the swimming pool.

take all due care with the Property during their stay and to leave same in a reasonable state of cleanliness/tidiness.

adhere to and to ensure that any accompanying guests adhere to the House Rule of no animals on the Property and no smoking inside the house located on the Property.

vacate the Property no later than 10:00 am on the date of departure (N.B. The cleaners may arrive at the Property from 08:00 am onwards on the day of departure, with prior notification from the Property Manager).

be liable for all damaged goods, damage to the Property or anything else arising from their occupation of the Property, beyond normal wear and tear, whether caused by themselves or any visitors.

Please note that a 1000€ cash security deposit is payable. 

This cash security deposit will be fully refundable provided that:

  • No damage is done to the Property including any contents beyond normal wear and tear. If damage is done then costs deducted will relate to costs associated with repairing or replacing the damaged item(s). If any damage done causes compensation payments to future renters, these costs will also be charged to the Renters.
  • All debris, rubbish and discards are disposed of in the appropriate rubbish bin.
  • All keys and remote controls are returned to the Property Manager. 

  • Any charges incurred during the stay are paid prior to departure.

The Owner confirms that::

the villa is available from 04:00pm on the first day of arrival until 10:00am on the day of 
departure. 


the villa is fully cleaned and tidy prior to the Renter(s)’ arrival, and, if 
agreed by prior arrangement, during their stay.

the villa is fully equipped with towels, pool towels, bed linen etc.

no additional charges will be levied for electricity, WiFi, heat or water.

Concierge service is available

A tidy housekeeping during the week is included, more on extra charge available

Laundry service, Chef available for extra charge  more on extra charge available

daily gardening and pool service (Monday to Friday)

The Owner shall not be liable to the Renter(s) for

- Any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery appliance in the Property, garden or swimming pool.

- Any loss, damage, injury or death that is the result of adverse weather conditions, riot, strikes, war or other matters that are beyond the control of the Owners.

- Any loss, damage or inconvenience caused or suffered by the Tenant if the Property shall be destroyed or substantially damaged before the start of the rental period. In any such event, the Owners shall refund, within two working weeks of notification to the Tenant, all sums previously paid to the Owners for the rental period. In the event of the booking being cancelled or altered by reason of force majeure (which includes floods, storms, riots, strikes, wars, and Acts of God) or other events outside the Owners’ control, the Owners cannot accept any liability.

These terms and conditions shall be governed by the laws of Spain.
